Gated community plot

A developer buys a larger parcel, gets a layout approved, builds internal roads, drainage, street lights and often a compound wall, gate and park, and then sells individual plots. Some projects add a clubhouse or offer to build your house for you.

Individual plot

This is a standalone site, often bought from a landowner or from a plot in an older approved layout. There is no developer managing common facilities, and you deal directly with the seller.

The legal side in Tamil Nadu

Layout approval

TNRERA registration

Plotted developments are covered by RERA. A layout on more than 500 sq m of land, or with more than eight plots, must be registered with TNRERA before it is advertised. Registration gives you access to the approved layout, the promoter’s disclosures and a complaint route. A single plot bought from an individual owner is outside RERA, so your own due diligence carries more weight.

Roads and open space are not private

Under the Tamil Nadu Combined Development and Building Rules, 2019, approved layouts reserve open space (commonly 10% of the layout area) and hand the roads and OSR land to the local body by gift deed. That means a “gated” layout’s roads are usually public in law, and a gate cannot lawfully keep the public out of them. Ask the developer how the gate, security and maintenance are organised and whether the gift deeds are registered.

Money matters

  • Stamp duty and registration: 7% stamp duty and a 2% registration fee on the guideline or agreed value, whichever is higher, for either type.
  • GST: the sale of land itself is outside GST. If a developer charges separately for development or amenities, ask how the invoice is structured and confirm the tax treatment with your accountant.

  • Running costs: budget for maintenance charges in gated projects and for fencing and clearing on a standalone plot.

Checklist before you pay an advance

  1. Verify the layout approval number and match your plot number to the approved plan.
  2. For developer layouts, check TNRERA registration and the promised completion date for amenities.
  3. Obtain the parent documents, patta and encumbrance certificate, and get a legal opinion.
  4. Visit during the monsoon to check drainage and access.
  5. For individual plots, confirm the approach road is a public road or has a registered right of way.
  6. Read any community rules on building height, fencing and use before you sign.
