What is assigned land?

Over the decades, the Tamil Nadu government has assigned government land, including unobjectionable poramboke and surplus land, to landless agricultural workers, families needing house sites, ex-servicemen and other eligible groups. The assignment is recorded in an order and a patta, sometimes known locally as a DKT (darkhast) patta. Typical conditions include:

  • A bar on sale, mortgage or other transfer for a fixed period, or permanently except with permission
  • A requirement to cultivate the land or build a house within a set time
  • In some cases, transfer allowed only to persons of the same eligible group
  • Government’s right to cancel the assignment and resume the land if conditions are broken

The exact conditions vary with the scheme and the year of assignment, so the order itself matters. That is why the phrase “conditional patta” is used: the patta is genuine, but the holder’s rights to deal with the land are limited.

What is Panchami land?

In 1891, J. H. A. Tremenheere, then Collector of Chingleput, reported on the condition of Dalit agricultural workers. Following his recommendations, the government from 30 September 1892 began assigning land free of cost to the depressed classes. Roughly 12 lakh acres are said to have been assigned across the Presidency. The conditions barred sale for the first ten years and, after that, allowed transfer only to members of the same community.

Over time, much of this land passed to others in breach of those conditions. The State has formed committees at different times to identify and restore Panchami land. In a 2010 judgment, the Madras High Court upheld the validity of these restrictions and held that alienation in violation of them is void, and that the purchaser gets no valid right, title or interest, even where the original sale was decades old.

A long chain of registered sale deeds does not protect you. The restriction attaches to the land, and later buyers are in no better position than the first.

How to spot assigned or Panchami land

  2. Trace the title to its origin. A title search should go back to how the land first came into private hands. If it began with a government grant, ask for the assignment order.
  3. Check the old survey records. Settlement records and old registers at the taluk office may show the original classification.
  4. Ask the VAO and taluk office. Local officials often know which survey numbers were assigned lands.
  5. Look at the price. A plot far cheaper than similar land nearby may be priced for a reason.

Can conditions ever be lifted?

For ordinary assigned land, the government may in some cases permit transfer after the restricted period or on application, and some schemes allow sale once conditions have been met. Any such permission should be in writing from the competent revenue authority and should be checked by your advocate. For Panchami land, the protective conditions are treated very strictly, and a buyer outside the protected community should not proceed.

A note of fairness

These rules exist to protect families who were given land to overcome historic disadvantage. Respecting them is both a legal necessity and the right thing to do. If a seller suggests ways to “manage” the restriction, such as a long lease, a power of attorney or an unregistered agreement, treat it as a warning, not a solution.
